1. About Marketly

Marketly is an AI-powered marketing assistant for small businesses. It provides generators that produce marketing copy and creative drafts (including Google Ads, SEO meta tags, product descriptions, Instagram captions, Facebook ads, email marketing, TikTok hooks, and website hero copy) based on your brand inputs.

By creating an account or using Marketly, you agree to these Terms. If you do not agree, please do not use Marketly.

2. Accounts and Eligibility

To use most of Marketly, you sign in with Google. You're responsible for the accuracy of the information you provide and for any activity that happens under your account. You must be at least 18 years old (or the age of majority in your jurisdiction) and authorized to enter into this agreement on behalf of yourself or the business you represent.

3. Brand Profile and Inputs

You may save a brand profile (business name, industry, tone, target audience, keywords, brand style, and CTA preference) and submit per-generation inputs. We use this information to tailor the AI output to your brand.

You retain ownership of the brand profile and inputs you provide. By submitting them, you grant Marketly a limited license to process them solely to operate the service for you.

4. AI-Generated Content

Marketly uses third-party large language models to generate content. AI output can be inaccurate, outdated, biased, or unsuitable for your specific use case.

You are solely responsible for reviewing, editing, and verifying any AI-generated content before publishing or using it commercially. Marketly makes no warranty that generated content is accurate, fit for purpose, non-infringing, or compliant with applicable laws, advertising standards, or platform policies.

To the extent permitted by law, you own the output you generate from your own inputs and may use it commercially, subject to the third-party AI provider's terms.

5. Public Sharing and Showcase

Marketly lets you create public share links for any generated result and, if you choose, opt that result into a public Showcase. If you choose to share or feature content:

  • The link and its content become publicly accessible to anyone with the URL (and, for Showcase opt-ins, to anyone browsing the Showcase).
  • Public pages and Showcase entries display only the generated copy, a title, and a generic generator label. They do not display your account email, name, profile picture, brand profile, or raw inputs.
  • You can revoke any share link or remove an entry from the Showcase at any time from your account.
  • Marketly may moderate, hide, or remove Showcase entries that violate these Terms, applicable law, or our acceptable-use policy at our discretion.

6. Acceptable Use

You agree not to use Marketly to generate or share content that:

  • is illegal, fraudulent, deceptive, or designed to harass, defame, or threaten others
  • infringes any third party's intellectual property, privacy, or publicity rights
  • contains malware, spam, or attempts to bypass platform security
  • promotes regulated products or services in jurisdictions where doing so is prohibited
  • impersonates another person or business in a misleading way

We may suspend or terminate accounts that violate these rules.

7. Plans, Credits, and Payments

Marketly offers a free plan with a limited monthly credit allowance and paid plans with higher allowances and additional features. Pricing and feature details are shown on the Pricing page and may change.

Payments are processed by Stripe. When you upgrade, you provide your payment details directly to Stripe; Marketly does not see or store your full card number, expiry, or CVC. Stripe sends a receipt to the email associated with your purchase.

One-time payments grant the credits and features of the plan you purchased, applied to your account once the payment succeeds. Unused credits do not roll over indefinitely; the current rollover policy is described on the Pricing page. Refund requests are evaluated case by case and can be sent to cecilia@usemarketly.com.

8. Cookies, Sessions, and Analytics

Marketly uses an authentication session cookie to keep you signed in and basic analytics to understand how the product is used (for example, which generators are popular and where users get stuck). See our Privacy Policy for details.

9. Intellectual Property

Marketly, including its branding, copy, design, and software, is owned by us and our licensors. You may not copy, reverse engineer, or build a competing product using Marketly itself. The "Marketly" name and logo are not licensed for your use except to truthfully reference the service.

10. Service Availability

Marketly is provided "as is" and "as available." We work hard to keep it up, but we do not guarantee uninterrupted availability, error-free operation, or specific response times. We may add, change, or remove features as the product evolves, especially during the beta period.

11. Limitation of Liability

To the maximum extent permitted by law, Marketly and its operators are not liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenues, data, or goodwill, arising out of your use of the service. Our total liability for any claim relating to the service is limited to the amount you paid Marketly in the twelve months preceding the claim.

12. Termination

You can stop using Marketly at any time and request account deletion by emailing cecilia@usemarketly.com. We may suspend or terminate accounts that violate these Terms or that are inactive for an extended period.

13. Changes to These Terms

We may update these Terms from time to time. When we do, we'll update the "Last updated" date at the top of this page. Material changes will be communicated by email or in-app notice. Continued use of Marketly after changes take effect constitutes acceptance.
